Silence Isn't Coverage.

A family calls the community and says the website's chatbot told them memory care was included in the base rate. It wasn't. They moved Mom in on that understanding, and now there's a demand letter on the executive director's desk. Which policy responds?

Most leaders answer "cyber" without thinking. The honest answer is that nobody has checked.

A RAND Corporation study of actual admitted-market insurance filings, reported September 18, found the market split three ways on AI. A minority of carriers affirmatively cover AI losses. A growing number have filed broad exclusions. The majority remain silent (Insurance Business). RAND also found AI-related losses span at least 11 insurance lines.

Beazley's 2026 Digital Health & Wellness report gave the problem a name: the liability chain. One AI-assisted harm event can generate claims across medical professional liability, cyber, technology errors and omissions, and general liability at once, naming the vendor, the clinician, and the organization together (Insurance Business). Beazley's survey was 600 digital health executives, not senior housing, and Beazley writes that business. But its claims team specifically flagged chatbots and intake tools where people may not realize they are talking to AI.

The buyers who noticed are consolidating. The share of digital health firms buying a single, tailored multi-risk policy rose from 40% in 2024 to 53% in 2026, per Beazley. Silence feels like coverage until two carriers each argue a claim belongs to the other.
